Digital Product Terms, Privacy & Refund Policies

These policies apply specifically to digital guides, downloadable resources, and other digital educational products (“Digital Products”) offered for purchase by Amy Teumer Counseling, LLC (“we,” “us,” or “our”) through this website.

These policies do not govern therapy, counseling, coaching, Autism or ADHD evaluation services, or any other professional services provided by Amy Teumer Counseling, LLC. Those services are separate from the purchase of Digital Products and may be subject to separate agreements, informed consent documents, privacy practices, cancellation policies, and other terms provided in connection with the applicable service.

Purchasing or using a Digital Product does not establish a therapist-client, counselor-client, coaching, evaluator-client, or other professional healthcare relationship with Amy Teumer Counseling, LLC or any of its providers.

References to “Digital Products,” “products,” “purchases,” or “customers” within these policies relate only to Digital Products unless expressly stated otherwise.

By purchasing or using a Digital Product, you acknowledge that you have read and agree to the applicable policies below.

Terms of Service

1. Digital Products and Educational Purpose

Amy Teumer Counseling, LLC offers Digital Products that may address topics including Autism, ADHD, AuDHD, neurodivergence, self-discovery, assessment and evaluation processes, and related areas.

Digital Products are provided for general educational and informational purposes only. They do not constitute therapy, counseling, coaching, medical advice, mental health treatment, psychological assessment, diagnosis, or individualized professional advice.

Information contained in a Digital Product should not be used as a substitute for individualized evaluation, treatment, or care from an appropriately qualified professional.

Purchasing, downloading, accessing, or using a Digital Product does not establish a professional or healthcare relationship with Amy Teumer Counseling, LLC or any of its providers.

2. Separation From Professional Services

Digital Products are offered separately from therapy, counseling, coaching, Autism or ADHD evaluations, and other professional services offered by Amy Teumer Counseling, LLC.

Purchasing a Digital Product:

  • Does not enroll you in therapy, counseling, coaching, or evaluation services;

  • Does not guarantee eligibility or availability for professional services;

  • Does not constitute an evaluation or diagnosis;

  • Does not create a therapist-client, counselor-client, coaching, evaluator-client, or other professional relationship; and

  • Does not replace any agreement, informed consent, privacy notice, cancellation policy, or other document applicable to professional services.

If you separately engage Amy Teumer Counseling, LLC for professional services, the terms and policies governing those services will be provided separately as applicable.

3. Purchases and Paddle

Digital Product transactions may be processed through Paddle, our authorized reseller and Merchant of Record.

For transactions processed through Paddle, Paddle facilitates the order and payment process and is responsible for payment processing and applicable transaction taxes, including sales tax, VAT, GST, or similar taxes where required.

Purchases processed through Paddle may also be subject to Paddle's applicable buyer terms, privacy policies, and other transaction policies.

Amy Teumer Counseling, LLC remains responsible for the content and delivery of its Digital Products and for product-related customer support.

4. Digital Delivery

Digital Products are delivered electronically. Depending on the product, access may be provided through a download link, email, webpage, or another electronic delivery method.

Customers are responsible for providing accurate contact information at checkout.

Customers are also responsible for downloading and maintaining their own copy of purchased materials when applicable.

If you experience a technical problem accessing a Digital Product you purchased, contact support@amyteumercounseling.com. We will make reasonable efforts to resolve the issue and provide access to the product purchased.

5. Personal-Use License

Unless otherwise stated, purchasing a Digital Product grants the purchaser a limited, non-exclusive, non-transferable, revocable license to use the material for personal, non-commercial purposes.

Purchasing a Digital Product does not transfer ownership of the underlying intellectual property.

Unless you receive prior written permission from Amy Teumer Counseling, LLC, you may not:

  • Resell or commercially distribute a Digital Product;

  • Redistribute or share purchased files with individuals who have not purchased them;

  • Reproduce or republish substantial portions of a Digital Product;

  • Upload purchased materials to public websites, file-sharing platforms, shared resource libraries, or similar services;

  • Modify, repackage, or adapt the materials for resale or commercial distribution;

  • Remove copyright or ownership notices; or

  • Represent our content or materials as your own work.

All copyrights, trademarks, written content, designs, graphics, worksheets, and other intellectual property associated with our Digital Products remain the property of Amy Teumer Counseling, LLC or their respective rights holders.

6. No Guaranteed Results

Digital Products are intended to provide education, reflection, information, and practical resources. Individual experiences and outcomes vary.

Amy Teumer Counseling, LLC does not guarantee that use of a Digital Product will result in a particular diagnosis, evaluation result, treatment outcome, personal outcome, professional outcome, or other specific result.

A Digital Product should not be interpreted as confirming or ruling out any diagnosis or condition.

7. Accuracy and Updates

We make reasonable efforts to provide accurate and useful information. However, research, clinical terminology, diagnostic standards, laws, professional practices, and available resources may change over time.

We may revise, update, replace, or discontinue Digital Products or related website content at our discretion.

Unless otherwise stated, purchasing a Digital Product does not guarantee access to future editions, revisions, or updates.

8. Availability

We make reasonable efforts to maintain access to our Digital Products and electronic delivery systems but cannot guarantee uninterrupted or error-free availability.

Temporary interruptions, technical problems, maintenance, or circumstances outside our reasonable control may occasionally affect access or delivery.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Amy Teumer Counseling, LLC will not be liable for indirect, incidental, special, consequential, or similar damages arising from the purchase, use, misuse, or inability to use a Digital Product.

Nothing in these Terms is intended to exclude or limit rights or liabilities that cannot legally be excluded or limited.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, except where applicable consumer law provides otherwise.

Digital Product purchases may be processed through Paddle, which acts as Merchant of Record for transactions processed through its platform.

Paddle may collect and process information necessary to complete transactions, including payment, billing, tax, fraud-prevention, and transaction information.

Information collected directly by Paddle is handled according to Paddle's applicable privacy policies and terms.

5. Website and Other Service Providers

Our website is hosted through Squarespace.

We may use other third-party providers for functions such as payment processing, digital delivery, website analytics, email communications, customer support, reporting, and business administration.

These providers may process information as reasonably necessary to provide their services and according to their respective privacy practices.

Digital Product Refund Policy

1. Digital Products Are Final Sale

All sales of Digital Products, including digital guides, downloads, and other immediately accessible digital resources, are final and non-refundable, except where a refund, cancellation, or withdrawal right is required by applicable law.

Because Digital Products are delivered electronically and access may be provided immediately following purchase, they cannot be physically returned once delivered.

We therefore do not generally provide refunds or exchanges for reasons including:

  • Change of mind;

  • Accidental purchases;

  • Failure to use or download the purchased product;

  • Purchasing a product that you later determine is not applicable to your circumstances; or

2. Technical or Delivery Problems

A technical access issue does not automatically qualify a purchase for a refund when the product can reasonably be redelivered or access restored.

3. Duplicate or Incorrect Charges

If you believe you were charged more than once for the same purchase or believe a transaction was processed incorrectly, please contact us or Paddle customer support so that the transaction can be reviewed.

4. Paddle Transactions

Transactions processed through Paddle are also subject to Paddle's applicable buyer terms and refund procedures.

Because Paddle acts as Merchant of Record, Paddle may process refunds, chargebacks, reversals, or other transaction adjustments when required by applicable law, Paddle's policies, or the circumstances of a particular transaction.

Nothing in this Refund Policy is intended to restrict Paddle's obligations as Merchant of Record.

5. Mandatory Consumer Rights

Nothing in this Refund Policy is intended to waive or restrict a consumer right that cannot legally be waived.

Customers in certain jurisdictions may have statutory cancellation, withdrawal, refund, or other consumer rights relating to digital content. Where such rights apply, applicable law will control.

6. Professional Services Are Not Covered by This Refund Policy

This Refund Policy applies only to Digital Products.

It does not apply to payments, deposits, fees, cancellations, missed appointments, refunds, or other financial arrangements associated with:

  • Autism, ADHD, or other evaluations;

  • Consultations; or

The payment, cancellation, and refund terms applicable to professional services are governed by the separate agreements, informed consent documents, policies, or other terms provided in connection with those services.
